SMS Terms & Consent
1. Who this applies to
This page applies to two audiences:
- Operators — trade-services businesses that use Recovery Console to dispatch SMS to their own customers. By using the SMS feature you accept the obligations in this document.
- End-recipients — the customer of an operator who receives an SMS dispatched through Recovery Console. Use this page to understand what you consented to and how to opt out.
2. Operator obligations
You may dispatch SMS through Recovery Console only if:
- You have prior express consent from the recipient to send the type of message you are sending, in compliance with the Telephone Consumer Protection Act (TCPA, 47 U.S.C. § 227) and applicable state law.
- You retain a record of the consent (date, channel, opt-in language) for at least 4 years and can produce it on demand.
- Your messages identify your business by name and provide contact information.
- Your messages include opt-out instructions on the first message in any campaign and on at least every fourth message in a recurring sequence.
- You do not use the Service to dispatch messages prohibited by carrier policy (“SHAFT”: Sex, Hate, Alcohol, Firearms, Tobacco) outside the carrier allow-list rules.
Recovery Console enforces several of these requirements at the platform level:
- STOP — replies of
STOP,UNSUBSCRIBE,CANCEL,END,QUITautomatically suppress all further outbound SMS to the sender across your account. - HELP — replies of
HELPorINFOtrigger a templated response with your business name and support contact. - Quiet hours — outbound SMS is suppressed between 9pm and 8am recipient-local time; messages queued during quiet hours are released the following morning.
- Frequency cap — no more than 4 outbound SMS per recipient per 24-hour period across all automations, regardless of how many rules match.
3. Consent language we recommend
When collecting consent at lead-capture or service-request, we recommend operators use language similar to:
This is illustrative, not legal advice. Operators should have the consent flow they actually use reviewed by counsel for compliance with TCPA and applicable state law.
4. Information for end-recipients
You are receiving SMS from a Recovery Console operator (a trade-services business such as an HVAC, plumbing, or electrical company) because that business’s records indicate you consented to be contacted.
- To stop receiving messages, reply
STOPto any message. You will receive one confirmation message and no further marketing or service messages from that business through Recovery Console. - For help, reply
HELPfor the business’s contact information. - Message frequency varies. You should expect at most a few messages per service interaction.
- Message and data rates may apply per your wireless carrier’s plan.
- If you believe you received a message in error, reply
STOPand email abuse@dorsey-worx.com with the message you received and the sender’s phone number.
5. Carrier & provider
Outbound SMS is delivered via Twilio, a US-based licensed carrier. Recovery Console registers each operator’s sending number under the Twilio A2P 10DLC framework. Operators that have not completed A2P registration cannot dispatch SMS through the Service.
6. Data we retain
We retain a copy of every outbound SMS payload, delivery status from the carrier, and any inbound replies (including STOP / HELP confirmations) for the retention windows listed on the Data Policy page. Suppression records (numbers that have opted out) are retained for the life of the operator’s account so they cannot be re-contacted in error.
Consent audit log. Every consent event — opt-in,
STOP/UNSUBSCRIBE, HELP, START/UNSTOP, or operator-recorded change — is appended to
an immutable audit ledger keyed on the contact’s phone number. Operator-account
owners can self-serve a complete consent-history export
(CSV or JSON) at any time from
GET /api/account/consent-audit-report?format=csv. The export is the
authoritative record an operator would cite in a TCPA defense.
7. Reporting violations
If you believe an operator on Recovery Console is violating TCPA, sending without consent, or otherwise misusing the SMS feature, please report it to abuse@dorsey-worx.com with as much detail as you can provide (the message, sender phone number, time received). We investigate every report and may suspend or terminate operators found in violation under our Terms of Service.
